Within 60 days, DGS should either make a request to the State Personnel Board to take disciplinary action against the supervisor or attempt to work with the supervisor's current state employer to take disciplinary action.

DGS reported that in coordination with the supervisor's employer, it drafted a disciplinary action that would have dismissed the supervisor from state service. However, just prior to the employer serving the action, the supervisor resigned.

DGS submitted a request to the State Personnel Board (SPB) to take disciplinary action against the supervisor, but SPB denied the request for various legal reasons. DGS stated that it planned to contact the supervisor's current state employer to pursue disciplinary action.
