Report 2020-111: Los Angeles Community College District Personnel Commission: Its Inconsistent Practices and Inadequate Policies Adversely Affect District Employees and Job Candidates, Leading to Concerns About the Fairness of Its Decisions (Release Date: May 2021)

Recommendation #15 To: Los Angeles Community College District

To ensure that it consistently identifies and responds to all complaints and to reduce the risk of retaliation against complainants, by October 2021 the Commission should amend its rules to establish that complainant information may not be shared with the subject of a whistleblower complaint.

Annual Follow-Up Agency Response From February 2025

As we noted in our initial response to the May 2021 audit report, we contend that whistleblower complaints do not fall within the purview of the Personnel Commission. They are regulated by the Government Code and not the Education Code that addresses the provisions for a merit system. The District has a whistle blower policy and processes in place that are overseen by the Internal Audit Department of LACCD. In the unlikely event that our office would receive a whistleblower complaint, we would immediately refer that item and complainant to the Office of Internal Audit for processing. Any information shared with us would be kept confidential.
