Recommendation #12 To: Los Angeles Community College District

To ensure that employees are fairly compensated for the entirety of the out-of-class work they perform, the Commission should amend its rules by October 2021 to require employees to submit a copy of their out-of-class claim form to the Commission at the same time as they submit it to their supervisors, and use the date the Commission receives this copy of the form as the date of submission.

Annual Follow-Up Agency Response From February 2025

As we noted in our initial response to your May 2021 audit report, we did not agree with this recommendation to amend our Rule 550 to require employees to submit a copy of the claims to the Commission when they submit the claim to their supervisor and administrators for signatures and use this date as the recognized date for submission. A duly authorized supervisor must certify that the out-of-class work was assigned prior to processing any claims since assignment of duties is within the purview of management and not the employee (see Ed Code 88095). Additionally, Rule 550 already addresses situations where the untimely filing of a claim may be excused under certain circumstances and the increase of allowable days to submit a claim timely to 100 days will also aid in mitigating those circumstances.
