To ensure that it provides effective oversight of health and safety issues on the campuses, the Chancellor's Office should, using the information from recommendation 1, develop and implement a plan by January 2019 to ensure that the campuses have taken appropriate actions to comply with health and safety requirements.
1-Year Agency Response
The division of Audit and Advisory Services developed and began implementation of an audit plan to conduct health and safety audits at all the campuses. The four campuses that were part of this audit will receive a review of their implementation of the recommendations as opposed to another full audit. As of April 2019, preliminary draft reports have been sent to two campuses, report writing is in process for three campuses, fieldwork is in process at seven campuses, and the Chancellor's Office and remaining eleven campuses are scheduled to start during 2019.

As confirmed by the State Auditor, the Chancellor's Office provided evidence demonstrating that it developed a uniform health and safety reporting template and required the campuses to use it to annually report information related to campus health and safety, including data regarding employee and student training and other areas the Chancellor's Office considers critical to its oversight of health and safety compliance. In October 2019, the Chancellor's Office updated the reporting template to include a comparison of the number of students and employees required to receive required training to address whether the training is adequate.

The Chancellor's Office provided evidence demonstrating that it developed a uniform health and safety reporting template and required the campuses to use it to annually report information related to campus health and safety, including data regarding employee and student training and other areas the Chancellor's Office considers critical to its oversight of health and safety compliance. It also provided evidence demonstrating that it considered information from its own health and safety-related audits as well as findings and recommendations of this audit.
However, although the new reporting template includes data regarding employee and student training, it does not address whether the training is adequate. Specifically, it only identifies the number of students and employees trained and does not include a comparison of the number of students and employees required to receive required training.

In addition, we have gone a step further by updating existing policy to provide a framework for administrative environmental health and safety processes, assessment, and reporting.

Campuses submitted their reports in late 2019. The responses were assessed by Systemwide Risk Management at the Chancellor's Office to identify trends, risks, and best practices. Further, several recommendations for improving the process were also made. The results were presented to the campus Environmental Health & Safety Directors Affinity Group in January 2020. In addition, improvements have been made to the annual reporting template to provide more comparable data in the future.

Systemwide Risk Management received and evaluated the information in the 2020 annual reports and made recommendations to the campuses.
The Chancellor's Office follows up on the campuses' implementation of corrective actions via the annual reporting process. In addition, a report was presented to the Chief Administrators and Business Officers affinity group in June 2021 and administrators were asked to follow up on the campus-specific findings and recommendations.

Once it has developed the health and safety reporting template and campuses have used it to submit their reports, the Chancellor's Office should incorporate the risks identified in its assessments into the University Auditor's audit plan to ensure that the University Auditor evaluates problem areas related to campus health and safety.

Annual Follow-Up Agency Response From October 2020
As part of the 2019 audit plan, the division of Audit and Advisory Services completed health and safety audits at all 23 campuses and the Chancellor's Office. The audits reviewed areas similar to those reviewed by the State Auditor.
In addition, after analyzing the data from the first round of annual reports, Systemwide Risk Management determined that revisions to the reporting template were needed. The second round of annual reports is due in November 2020, and Systemwide Risk Management will annually share the risks identified by their assessment of the annual reporting data with Audit and Advisory Services for inclusion in their audit planning.

To ensure that it identifies systemwide trends and makes appropriate recommendations to address health and safety issues, the Chancellor's Office should ensure that the systemwide joint committee meets and fulfills its responsibilities in accordance with the bargaining agreement by actively working with the union on an ongoing basis.

As reported in our 60-day response, the systemwide joint committee was formed and subsequently held its first meeting on June 7, 2018. The committee held its second meeting on October 4, 2018, and a third meeting is scheduled for January 10, 2019. The committee will continue to meet quarterly.

Recommendation #10 To: University, California State
To ensure the health and safety of employees working with hazardous materials, the Chancellor's Office should prescribe the frequency for which the campuses provide refresher laboratory safety training to employees.

Annual Follow-Up Agency Response From October 2020
As reported previously, the Chancellor's Office drafted a new policy to provide a framework for administrative health and safety processes, assessment, and reporting. The draft policy proposes that employees shall receive refresher laboratory safety training a minimum of every three years. Because the proposed policy changes may have an impact on the terms and conditions of employment, and after meeting with the three unions that requested to meet and confer, an updated draft was provided to all employee unions in December 2019 for further review. Only one union (CSUEU) requested to again meet and confer on the revised document but did not provide any dates and has not identified any reasonably foreseeable impact of the revised draft policy. CSU made several attempts to obtain dates from the union. After notifying the union on October 15, 2020 of the CSU's intention to implement the policy on or after November 2, 2020, unless the union articulates reasonably foreseeable impacts and provides prompt dates, the union then indicated its intention to file an unfair labor practice charge with the Public Employment Relations Board for violation of the collective bargaining law (HEERA) if the CSU implements the new policy. The CSU continues to seek dates from the union to complete the meet and confer process.

Proposed policy changes that may impact the terms and conditions of employment have to be provided to the unions for their review. The Chancellor's Office provided the draft policy to the unions in March 2019 and three unions requested to meet and confer. To date, Systemwide Risk Management has met with all three unions and is in the process of incorporating recommended and agreed to edits to the policy. The meet and confer process takes several months and based on the feedback from the aforementioned meetings, we anticipate closure of the meet and confer process by April 2020.

To ensure that it receives feedback from employee representatives on conditions associated with their work environments and that it develops appropriate interventions, Channel Islands should ensure that its joint committee meets and fulfills its responsibilities in accordance with the bargaining agreement. If such committee does not exist, it should work with the union to form it by September 2018.

San Diego State University (SDSU) has updated its process for ensuring that departments are providing safety training to students and retaining student acknowledgements. Environmental Health and Safety (EHS) has developed a safety training module in Canvas, our course management system, which faculty can import into their course and consists of a video and short survey that includes the student acknowledgement. Faculty are also able to develop a customized safety training module and include the student acknowledgement in a quiz or survey. When students complete the safety training module, their survey or quiz is retained in the Canvas course record.
Every semester, EHS selects a sample of courses to audit for compliance with student training and works with Instructional Technology Services to get access to the selected courses in Canvas. EHS reviews the course to ensure a safety module was incorporated into the course and to assess the number of students that completed the survey at the end of the module, which includes the student acknowledgement. As the safety training is completed in Canvas, the information is retained indefinitely with the course record. Additionally, EHS continually reviews course offerings to ensure new or removed courses are identified and the training module is included for the instructor.

The campus issued a self-audit directive on June 18, 2018. For Risk and Safety Solutions (RSS) assessment and inspections modules, trainings for faculty and staff are available online. A memo was sent to relevant faculty and staff on September 6, 2018 announcing the availability of the RSS trainings and directions for how to access the trainings. The campus is implementing enforcement of the requirement.
The Environmental Health and Safety (EHS) department has attached the Provost's June 2018 directive requiring semi-annual self-audits to the revised Chemical Hygiene Plan (CHP). The CHP appendices also include a self-audit lab safety checklist.

Currently SDSU is utilizing a new software application, Risk and Safety Solutions, to better document compliance inspections of laboratory and workshop facilities. Environmental Health and Safety Department (EHS) Compliance Officers conduct inspections three times yearly. Non-compliance items should be resolved within 30 days. Corrections to non-compliance issues are noted by the responsible person designated for each laboratory facility or workshop area on the inspection reports. Compliance officers review or physically verify the corrections, if warranted. Compliance officers monitor unresolved non-compliance issues and will elevate to Department Chair or higher if necessary.
