To ensure that it fully complies with state law regarding investigations, the board should implement procedures to track the progress of investigations, including a procedure to identify those investigations that may exceed the 90-day deadline established in law.

The board stated that it has implemented a system of tracking the progress of open investigations by requiring a monthly report on the status of each open investigation and the expected reporting date and by tracking the expiration of the 90-day period in which investigation reports are to be presented, absent a timely extension for good cause. (See 2011-406, p. 96)
